Unless otherwise specifically stated, these Terms of Use apply to all Arcora Inc. websites, apps and content (collectively referred to as the “Websites”). By accessing and using the Websites, you agree to be bound by and comply with these Terms of Use.

Arcora, the Arcora logo and all Arcora product names may not be used as hyperlinks or reproduced without our prior written consent. The content and design, including all text, images, PDFs and software used on the Websites, are protected by copyright. Reproduction or redistribution of any part of the Websites is permitted only with our prior written consent. For permission to reproduce or republish any part of the Websites, please contact Arcora.

Accuracy of Information

The Websites are designed and intended for general information and reference purposes. They should not be used to replace contact with an Arcora representative. Please contact Arcora for answers to your questions.

The information provided on the Websites is subject to change and update without notice. Every reasonable effort is made to ensure the quality of information on the Websites; however, Arcora cannot guarantee the accuracy, completeness or timeliness of any site content, site functionality or your transmission of any site content from the site to you.

Other websites that may be accessed from the Arcora Websites by hypertext links are entirely independent of the Websites. Use of the Websites

You agree that your use of the Arcora Websites shall be on an “as is” basis entirely at your risk. Neither Arcora, nor any of its affiliates or employees, nor any other person associated with the creation of the Websites or their contents, shall be liable or responsible to any person for any harm, loss or damage that may arise in connection with your use of the Websites, including without limitation any direct, indirect, special, third party or consequential damages. Without limiting the foregoing, Arcora shall not be responsible for any detrimental reliance that you may place upon the Websites or their contents whatsoever.

Service Providers

Arcora may use service providers to perform certain functions on our behalf to optimize the services we provide. In these situations, Arcora will verify that the appropriate privacy and security protocols are in place before entering into contracts with the external service provider(s).

Dispute Resolution

Any disputes arising out of or related to these Terms of Use or your use of the Websites shall be resolved through negotiation, mediation or binding arbitration as mutually agreed upon by the parties.

Changes to Terms of Use

Arcora reserves the right to update or modify these Terms of Use at any time without prior notice. Your continued use of the Websites following any changes constitutes your acceptance of the new Terms of Use. We recommend that you review these Terms of Use periodically for any changes.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the province of Quebec and the laws of Canada applicable therein, without regard to conflict of laws principles. Any legal action or proceeding arising under these Terms of Use shall be brought exclusively in the courts of Quebec, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

Children’s Use

The Websites are not intended for use by children under the age of 13. If you are under 13, please do not use the Websites or provide any personal information. If we become aware that we have collected personal information from a child under the age of 13 without verification of parental consent, we will take steps to delete that information.

Account Registration

If the Websites require account registration, you agree to provide accurate, current and complete information about yourself. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. Arcora reserves the right to refuse service, terminate accounts or remove or edit content in its sole discretion.
